Boopit — Website Terms & Conditions (Waitlist / Pre-Launch)

1. About These Terms

These Terms and Conditions ("Terms") govern your access to and use of boopit.in ("Website"), currently operated by Ivamis Group, a sole proprietorship ("Boopit", "we", "us", "our"). Boopit is a brand/project operated by Ivamis Group at this pre-incorporation validation stage.

Boopit is currently in its pre-launch demand-validation and waitlist phase. These Terms apply only to the Website in its current validation-stage form and do not constitute the terms governing any future marketplace.

2. What Boopit Currently Does

Boopit is developing an online platform intended to connect pet parents with independent pet-service providers. Proposed services may include pet grooming, pet boarding and pet daycare. These services are not currently available through the Website.

The current Website is used to explain the proposed Boopit concept, collect expressions of interest, operate a waitlist, understand potential customer demand, conduct market/product research, and communicate with interested individuals about a potential future launch.

3. No Current Bookings, Purchases or Services

During the validation phase:

• no pet-service bookings can be made through Boopit;
• no pet-service payments are accepted;
• no service provider is being booked through the Website;
• no service provider is guaranteed to be available;
• no service contract is formed between a user and a pet-service provider through the Website; and
• joining the waitlist does not reserve a future service, create a purchase obligation, or guarantee that Boopit will launch;
• no consideration passes between you and Boopit by virtue of joining the waitlist, and nothing in this Section or elsewhere in these Terms is intended to create a contract, offer, or enforceable promise under the Indian Contract Act, 1872.

Any future marketplace functionality will be governed by separate terms and policies applicable at launch.

4. Eligibility

You must be at least 18 years old to use the Boopit waitlist. By joining the waitlist, you confirm that the information you provide is accurate to the best of your knowledge, that you are providing your own information or have appropriate permission to provide it, and that you will not use the Website for unlawful, fraudulent or abusive purposes.

5. The Waitlist

Joining the Boopit waitlist is free. The waitlist records an expression of interest and does not create an obligation on you or Boopit to enter into a future commercial relationship.

Boopit may use demand-validation information to evaluate potential launch locations, services, pricing, availability, eligibility and other commercial considerations. We may limit, suspend, modify or close the waitlist at any time.

Being on the waitlist does not guarantee launch, priority access, availability of a particular service, a particular price, or acceptance into any future marketplace.

You may leave the waitlist at any time by clicking "Leave the waitlist" in any waitlist communication we send you, or by emailing contact@boopit.in. Leaving the waitlist takes effect immediately and does not require you to provide a reason.

6. Information You Provide

The waitlist may ask for an email address and/or phone number so that we can contact you about a potential launch. It may also ask for optional information such as your name, locality, pet-service preferences, intended timing and approximate expected spending to help us understand demand.

Our collection and use of personal information is described in the Boopit Waitlist Privacy Policy. The Privacy Policy is incorporated by reference only for privacy/data-processing matters; these Terms do not replace or narrow the rights and choices described there.

7. Consent, Analytics and Communications

The waitlist form may contain a separate, unticked consent checkbox for the collection and use of information for the waitlist purposes described in the Privacy Policy. Optional promotional communications are not included in the core waitlist consent and, where consent is required or appropriate, will be offered through a separate optional opt-in.

Optional analytics are handled separately from the waitlist form. Boopit currently uses Google Analytics 4 as its only analytics service, treated as one optional analytics category for consent purposes. The Website’s analytics banner provides Accept and Decline choices. If analytics are declined, the Website should not load or use the optional analytics service. If analytics are accepted, it may operate in accordance with the Privacy Policy.

Joining the waitlist does not by itself constitute consent to optional analytics. The Website may use first-party session storage for limited campaign/referral attribution and essential technologies for basic Website operation as described in the Privacy Policy.

Boopit will provide a mechanism to manage or withdraw optional analytics consent. Withdrawal is intended to be as easy as giving consent.

8. No Guarantee of Launch

Boopit is currently testing market demand. We do not guarantee that Boopit will launch, that it will launch in a particular location, that a particular service will be offered, that a particular service provider will become available, that any stated or estimated price will apply after launch, or that waitlist members will receive priority access.

9. Website Content

We aim to keep information on the Website accurate and useful. However, information describing planned services, features, locations or future functionality may change during development. Content relating to planned features or services should not be interpreted as a current offer to provide those services.

10. Intellectual Property

The Website and its original content, including the Boopit name, logo, visual identity, text, graphics, designs, layouts, software and other materials made available through the Website, are owned by or licensed to Ivamis Group, or are in the process of being formally assigned to Ivamis Group by their respective creators, or are owned by Ivamis Group’s licensors, except where otherwise stated.

On incorporation of a private limited company for the Boopit business, Ivamis Group’s rights in this intellectual property will be assigned to that company under a separate deed.

You may access the Website for personal, non-commercial purposes. Without prior written permission, you may not reproduce substantial portions of the Website, commercially exploit Boopit’s original content, reproduce Boopit’s branding or logo, systematically scrape or collect information from the Website, use automated systems to abuse the Website or waitlist, or create misleadingly similar materials using Boopit’s branding or content.

"Boopit" and the Boopit logo are used by Ivamis Group as unregistered trade marks at this time. No representation is made that these are registered trademarks, and any such registration, if and when obtained, does not retroactively affect rights or obligations arising under these Terms.

Nothing in these Terms transfers ownership of Boopit’s intellectual property to you.

11. Prohibited Conduct

You must not interfere with the operation or security of the Website; attempt unauthorised access to systems or accounts; introduce malicious code or harmful software; scrape or harvest personal information; submit false or fraudulent information; abuse or manipulate the waitlist; attempt to disrupt the Website; use the Website for unlawful purposes; or impersonate another person or organisation.

12. Third-Party Websites and Services

The Website may contain links to third-party websites, platforms or services. We do not control those third parties and are not responsible for their content, availability, policies or practices. Your use of third-party services may be subject to their own terms and privacy policies.

13. No Professional or Veterinary Advice

The Boopit validation-stage Website is not intended to provide veterinary, medical, behavioural, legal or other professional advice. Any general information relating to pets is provided for informational purposes only. Consult an appropriately qualified professional for individual advice.

14. Website Availability

We do not guarantee that the Website will always be available, uninterrupted, secure or error-free. We may modify, suspend or discontinue any part of the Website at any time.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Boopit will not be responsible for indirect, incidental, special, consequential or similar losses arising from your use of the validation-stage Website.

Boopit’s aggregate liability to you arising out of or in connection with your use of the validation-stage Website, however arising, will not exceed INR 1,000 (Rupees one thousand) or the amount, if any, you have paid to Boopit in the twelve months preceding the claim, whichever is greater, save to the extent such limitation is not permitted under applicable Indian law.

Nothing in these Terms excludes, restricts or limits liability or rights that cannot lawfully be excluded, restricted or limited under applicable Indian law.

Because Boopit is currently not providing pet services or processing pet-service bookings, these validation-stage Terms do not allocate responsibility for incidents arising from grooming, boarding, daycare or other pet services. Any such allocation will be addressed in the terms applicable to the future marketplace.

16. Indemnity

To the extent permitted by applicable law, you agree to be responsible for losses, claims or reasonable costs arising directly from your unlawful use of the Website, fraud, intentional misuse, or material breach of these Terms.

Nothing in this clause requires you to indemnify Boopit for losses caused by Boopit’s own unlawful conduct or for liability that cannot lawfully be transferred to you.

17. Privacy

Your personal information is handled in accordance with the Boopit Waitlist Privacy Policy. The Privacy Policy explains what information we collect, why we collect it, how we use and share it, retention, analytics/cookies, and applicable rights and choices.

18. Changes to These Terms

We may update these Terms as Boopit develops, our practices change, third-party services change, or applicable legal requirements change. The updated version will be published on the Website with a revised "Last updated" date.

If Boopit begins operating a live marketplace, these validation-stage Terms will be replaced or supplemented by comprehensive marketplace terms addressing bookings, service providers, payments, cancellations, refunds, disputes, marketplace responsibilities and other applicable matters.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to any non-excludable statutory rights, including rights available under applicable consumer-protection law, courts having appropriate jurisdiction at Gurugram, Haryana shall have jurisdiction over disputes arising from these Terms or your use of the Website.

Nothing in these Terms is intended to prevent a person from exercising a statutory right to approach a forum, authority or court that cannot lawfully be excluded by contract.
